1 Master Terms of Service

1.1 Service Overview

ThesisOS is a software platform that provides market intelligence tools for prediction-market venues. The platform provides tools for wallet tracking, anomaly detection, market monitoring, and data analytics. ThesisOS does not provide brokerage services, does not custody funds or assets, and does not serve as an introducing broker, commodities trading advisor, futures commission merchant, or other regulated intermediary.

ThesisOS does not provide investment, trading, tax, legal, or financial advice.

1.2 No Advice; No Fiduciary Relationship

ThesisOS offers analytics and intelligence tools. Nothing on or through ThesisOS constitutes investment or trading advice, recommendations, endorsements, or fiduciary services. Users must make their own independent decisions.

By using ThesisOS, users acknowledge that they are solely responsible for evaluating whether any market, trade, or investment decision is suitable in light of their objectives and risk tolerance.

1.3 User Responsibilities

Users are responsible for:

• Credential management. Users must secure their own exchange credentials and signing keys.
• Compliance with venue rules. Users must comply with applicable venue terms, regulations, and local laws.
• Monitoring and risk management. Users should monitor their activity and exercise appropriate judgment.
• Payment of fees. Users are responsible for any exchange fees, taxes, or other costs associated with trades.

1.4 Service Limitations; No Execution Guarantee

ThesisOS and its underlying services are provided "as is" and "as available." ThesisOS does not guarantee:

• Uninterrupted or error-free operation of the platform;
• Delivery of data feeds or analytics;
• Pricing consistency or accuracy;
• That historical data will predict future outcomes.

Events outside ThesisOS's control—such as exchange outages, network interruptions, stale or missing data, extreme market conditions, or system bugs—may result in incomplete or delayed data.

1.5 Limitation of Liability

To the maximum extent permitted by law:

• Indirect and consequential damages: ThesisOS and its affiliates are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, trading losses, loss of opportunity, loss of data, business interruption, or reputational harm.
• Trading losses: ThesisOS disclaims all liability for trading losses or adverse market movements.
• Cap on direct damages: ThesisOS's aggregate liability for direct damages is limited to the lesser of (i) USD 1000 or (ii) the fees paid by the user to ThesisOS during the twelve months preceding the event giving rise to liability.
• No warranty: ThesisOS makes no warranties of any kind, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, or system compatibility.
• Carve-outs: These exclusions do not apply to liability arising from ThesisOS's gross negligence, willful misconduct, or fraud to the extent such liability cannot be disclaimed under applicable law.

1.6 Indemnity

Users agree to indemnify, defend, and hold harmless ThesisOS, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, fines, judgments, costs, and expenses (including attorneys' fees) arising out of or related to:

• User's violation of laws, regulations, or venue terms;
• User's misuse of credentials or platform features;
• User's data or integration causing infringement, misuse, or harm.

The indemnity excludes claims resulting solely from ThesisOS's gross negligence, willful misconduct, or fraud.

1.7 Governing Law; Dispute Resolution

This agreement and disputes arising under it are governed by the laws of the applicable jurisdiction, excluding conflict of laws principles. Users agree to resolve disputes through binding arbitration and waive class actions and jury trials to the extent permitted by law.

2 Risk Disclosure

2.1 Market Intelligence Risks

Market intelligence data carries inherent limitations. These include, but are not limited to:

• Stale or malformed data: Data feeds may produce stale data, out-of-sequence messages, or erroneous values.
• Data source failures: Data providers, APIs, or blockchain nodes may fail, causing delayed or missing information.
• Market data lags: Analytics may lag behind actual trading activity.
• Historical divergence: Historical patterns may not predict future outcomes.

2.2 Third-Party Dependencies

ThesisOS integrates with external data providers and blockchain networks. Failures by exchanges, data feeds, or hosting infrastructure are outside of ThesisOS's control.

ThesisOS disclaims liability for losses or failures caused by third-party systems. Users are responsible for evaluating the reliability of their chosen data sources.

2.3 No Guaranteed Outcomes

Past performance does not guarantee future results. Analytics and scoring provided by ThesisOS are for informational purposes only. Markets can behave unpredictably and may render historical models invalid.

3 Privacy & Data

ThesisOS collects only the data necessary to provide its services: account credentials, usage analytics, and device tokens for push notifications. ThesisOS does not sell user data to third parties.

Wallet data displayed in the app is derived from publicly available blockchain data. ThesisOS does not have access to users' exchange accounts or funds.

4 Beta and Experimental Features

Certain features may be labeled as "Beta" or "Experimental." These features are provided for testing and feedback purposes and may be incomplete, unstable, unsupported, inaccurate, or withdrawn without notice.

ThesisOS disclaims all liability for losses or damages arising from the use of beta or experimental features.
